1. Acceptance of Terms

By accessing or using HockeyShare, a service provided by HockeyShare LLC, a Delaware limited liability company ("HockeyShare," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years old or have parental consent to use this Service. By using HockeyShare, you represent and warrant that you meet these requirements.

2. Description of Service

HockeyShare is a comprehensive web-based platform designed for hockey coaches to manage their coaching activities, including but not limited to:

• Creating and managing hockey drills
• Building practice plans
• Managing team rosters and statistics
• Creating digital playbooks
• Tracking player performance (10k Pucks program)
• Accessing instructional video content
• Communicating with team members
• Managing team schedules and events

3. User Registration and Accounts

3.1 Account Creation

To access certain features of HockeyShare, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

3.2 Account Security

You are responsible for safeguarding your account credentials. HockeyShare will never ask for your password via email or phone. We implement security measures including:

• Account lockout after multiple failed login attempts
• CSRF protection for all forms
• Secure session management
• Optional two-factor authentication (when available)

4. Subscriptions and Pricing

4.1 Subscription Tiers

HockeyShare offers the following subscription levels:

• Free: Basic access with limited features
• Premium: Full access for individual coaches
• Association: Multi-user access for hockey organizations
• Pro: Advanced features for professional coaches

4.2 Billing

Paid subscriptions are billed through our payment processor and Merchant of Record, Paddle.com Inc. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan.

4.3 Refunds and Cancellations

You may cancel your subscription at any time from your account billing settings. For refund eligibility and how to request a refund, see our Refund Policy.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you create on HockeyShare ("User Content"), including drills, practice plans, playbooks, and other materials. By uploading content, you grant HockeyShare a non-exclusive, worldwide license to:

• Store and display your content within the Service
• Create backups for data protection
• Process your content for search functionality (via Meilisearch)
• Share content according to your privacy settings

5.2 Prohibited Conduct

You agree not to:

• Upload content that violates any laws or third-party rights
• Share inappropriate, offensive, or harmful content
• Attempt to access other users' accounts without permission
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service's operation
• Circumvent any security features or access restrictions
• Upload malicious code or viruses

5.3 Content Moderation

We reserve the right to remove any content that violates these Terms or is otherwise objectionable. All uploaded files are scanned for viruses using our security partners.

6. Intellectual Property Rights

6.1 HockeyShare Property

The Service, including its design, features, and content (excluding User Content), is owned by HockeyShare and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or organizational coaching activities in accordance with these Terms.

6.3 Feedback

Any suggestions, feedback, or ideas you provide about the Service may be used by HockeyShare without compensation or attribution.

7. Privacy and Data Protection

Your use of HockeyShare is also governed by our Privacy Policy, which details how we collect, use, and protect your information. Key points include:

• We use industry-standard encryption for data transmission
• Your data is stored securely using PlanetScale database services
• Files are stored using DigitalOcean Spaces with virus scanning
• We do not sell your personal information to third parties
• You can request deletion of your account and associated data

8. Third-Party Services

HockeyShare integrates with several third-party services to provide functionality:

• Paddle: Payment processing and Merchant of Record (PCI compliant)
• DigitalOcean Spaces: File storage and content delivery
• Meilisearch: Search functionality
• PlanetScale: Database hosting
• Cloudflare Turnstile: Bot protection
• BetterStack: Error logging and monitoring

Your use of these integrated services is subject to their respective terms and privacy policies.

9. Payment Terms

9.1 Payment Processing

All payments are processed securely through Paddle. We do not store credit card information on our servers.

9.2 Taxes

You are responsible for any applicable taxes related to your subscription, except where HockeyShare is required by law to collect such taxes.

9.3 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

10. Disclaimers and Limitations

10.1 Service Availability

While we strive for 100% uptime, we do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience technical issues.

10.2 Content Disclaimer

HockeyShare is a platform for user-generated content. We do not endorse, guarantee the accuracy of, or assume responsibility for any User Content.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOCKEYSHARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10.4 Coaching Disclaimer

HockeyShare provides tools for coaches but does not provide coaching advice. Users are responsible for ensuring their coaching methods are safe and appropriate.

11. Indemnification

You agree to indemnify and hold harmless HockeyShare, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Termination

12.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

12.2 Termination by HockeyShare

We reserve the right to suspend or terminate your account for:

• Violation of these Terms
• Non-payment of subscription fees
• Prolonged inactivity
• Any conduct harmful to other users or the Service

12.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• You may request an export of your data within 30 days
• We may delete your data after 90 days
• Any outstanding fees remain due and payable

12.4 Inactive Account Deletion

We reserve the right to delete accounts that have been inactive for three (3) years. An account is considered inactive if:

• There have been no logins to the account for three consecutive years, AND
• The account does not have an active paid subscription

Deletion of inactive accounts includes:

• Complete removal of the account and login credentials
• Deletion of all user-generated content including drills, practice plans, playbooks, and team data
• Removal of all associated files and media
• Permanent deletion that cannot be reversed

We may, but are not obligated to, send a warning email to the registered email address before deletion. It is your responsibility to keep your email address current and to log in periodically if you wish to maintain your account.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
